Terms of Service
These terms are an agreement between you and 2795748 Alberta Ltd. (“Karmatica”, “we”, “us”) about using Karmatica: the apps for iPhone and Android, the web app at app.karmatica.app, and this website. By creating an account or using Karmatica, you agree to these terms. Our Privacy Policy explains how we handle your information.
1. Who can use Karmatica
You must be at least 13 years old to create an account. If you’re under the age of majority where you live, please review these terms with a parent or guardian, who must agree to them for you. [Note for review: confirm the minimum age and the parental-consent wording for each region.] You agree to give a true birth year when you sign up, because we use it to apply our age rules.
2. Your account
- Each account is for one person. Keep your password private and secure.
- You’re responsible for what happens in your account. If you think someone else has used it, change your password and tell us.
- Use an email address you can reach: it’s how you reset your password and how we contact you about your account.
- Deleting your account. When you delete your account, we sign it out everywhere, lock it, and keep it for 7 days before deleting it for good. We also email you to say so. If you change your mind, or someone else deleted it, log in during those 7 days with your usual details (your email and password, or Apple or Google) and choose to reactivate it, and everything will be as you left it. After 7 days, your account and everything in it are deleted permanently and can’t be recovered, by you or by us.
3. What Karmatica is, and isn’t
Karmatica helps you plan small daily actions, track them, earn karma and reflect on your day. It’s a tool for motivation, and it isn’t medical, health, fitness or mental-health advice. Check with a qualified professional before starting a new exercise routine or making changes to your health.
Nobody reads or monitors your journal. If you’re going through a hard time, please reach out to someone you trust, or to your local emergency services if you’re in danger.
Reminders are scheduled on your device and depend on your device’s settings and operating system, which may delay or limit them. Please don’t rely on Karmatica for anything where a missed reminder could cause harm, such as taking medication.
4. The free plan and ads
Karmatica’s core features are free. On iPhone and Android, the free plan shows a few non-personalized ads to adults (18 and over), as described in our Privacy Policy. There are no ads on the web or for anyone under 18. Please don’t try to get around how ads are shown, other than by subscribing to Personal Plus.
5. Personal Plus
- Personal Plus is an optional subscription that removes ads and adds extended progress history and comparisons. Its features may change over time; we’ll tell you about significant changes.
- You buy Personal Plus in the iPhone or Android app, through the App Store or Google Play. It isn’t sold on the web, but it works on every device where you sign in to the same Karmatica account.
- Apple or Google charges you, under their terms. The price and billing period (monthly or yearly) are shown before you buy. [Note for review: add prices, taxes and any free trial once they’re set.]
- Your subscription renews automatically at the end of each period unless you cancel it in your App Store or Google Play account settings before it renews. Apple needs you to cancel at least 24 hours before the end of the current period. After you cancel, Plus stays on until the end of the period you’ve paid for.
- Refunds are handled by Apple or Google under their refund policies. If a purchase is refunded, Plus ends for that purchase.
- Deleting your Karmatica account doesn’t cancel your subscription. Cancel it with Apple or Google, or you may keep being charged.
- If you reinstall Karmatica or get a new device, sign in to the same account, or use Restore purchases in the app.
6. Karma, streaks and stars
Karma, streaks and stars are there to encourage you. They have no money value, can’t be bought, sold, transferred or exchanged for anything, and aren’t your property. We may correct them if they were counted wrongly, and we may change how they work.
7. Your content
The activities, notes, moods and journal entries you put into Karmatica are yours. You give us permission to store, copy, process and show them to you only as needed to run Karmatica for you: to sync them across your devices, compute your progress, make backups and produce your data export. This permission ends when you delete your content, or when your account is deleted at the end of its 7 days (see Your account), except for copies in backups, which are gone within 30 days after that.
You can delete your account at any time in the app, under Settings → Privacy & data, and ask us for a copy of your data whenever you like (see the Privacy Policy).
8. Using Karmatica fairly
When you use Karmatica, please don’t:
- break the law, or use Karmatica to harm anyone;
- try to get into someone else’s account or data;
- disrupt or overload Karmatica, get around its rate limits or security, or access it with bots, scrapers or other automated tools;
- copy, decompile or reverse engineer the apps, except where the law allows it despite this term;
- resell Karmatica, or get around our age rules, ads or Personal Plus in ways we don’t offer.
9. Our rights in Karmatica
Karmatica, including its apps, design, name, logo, text and code, belongs to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use Karmatica for your own, non-commercial purposes under these terms. If you send us ideas or feedback, we may use them without owing you anything.
10. Apple and Google
If you got Karmatica from Apple’s App Store or Google Play, their terms also apply to your download and purchases. [Note for review: decide whether to use Apple’s standard licence (EULA) or these terms as a custom licence. If these terms are the custom licence, keep the points below.] If you use Karmatica on an Apple device:
- These terms are between you and us, not Apple. We, not Apple, are responsible for Karmatica and its content.
- Your licence is to use Karmatica on Apple-branded devices you own or control, as allowed by the App Store’s usage rules.
- Apple has no obligation to provide maintenance or support for Karmatica.
- If Karmatica fails to meet any warranty that applies, you may tell Apple, and Apple may refund the price you paid for it. Apple has no other warranty obligation for Karmatica.
- We, not Apple, are responsible for any claims about Karmatica, including product liability, failure to meet legal or regulatory requirements, consumer protection and privacy claims, and claims that Karmatica infringes someone’s intellectual property.
- You confirm that you’re not in a country subject to a US government embargo or designated as supporting terrorism, and that you’re not on a US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
11. Changes, suspension and ending
- We keep improving Karmatica, so features may be added, changed or removed. If we stop offering Karmatica, we’ll give you reasonable notice and a chance to download your data.
- We may change these terms. If a change is significant, we’ll tell you in the app or by email before it takes effect. If you keep using Karmatica after that, the new terms apply; if you don’t agree, you can delete your account.
- You can stop using Karmatica and delete your account at any time.
- We may suspend or close an account that seriously or repeatedly breaks these terms, or where the law requires it. Where it’s reasonable, we’ll tell you first and explain why.
12. Disclaimers
We work hard to keep Karmatica running and your data safe, but Karmatica is provided “as is” and “as available”. To the extent the law allows, we don’t promise that it will always be available, on time or free of errors, that reminders will always arrive, or that data will never be lost, and we make no other warranties, express or implied. Nothing in these terms limits rights you have under consumer protection laws that can’t be waived.
13. Limits on our liability
To the extent the law allows, we’re not liable for indirect, incidental, special or consequential losses, or for lost data or profits, arising from your use of Karmatica. Our total liability for any claim about Karmatica is limited to the greater of the amount you paid for Personal Plus in the 12 months before the claim and [AMOUNT]. These limits don’t apply where the law doesn’t allow them, for example for liability that can’t be limited for death, personal injury, fraud or gross negligence. [Note for review: confirm the cap and the consumer-law carve-outs.]
14. Governing law and disputes
These terms are governed by the laws of [JURISDICTION]. If there’s a problem, please contact us first and we’ll try to resolve it informally. Any dispute that we can’t resolve will be handled by the courts of [JURISDICTION AND VENUE], unless the law where you live gives you the right to bring it in your local courts. [Note for review: choose the governing law, venue and any dispute-resolution process.]
15. General
These terms and our Privacy Policy are the whole agreement between you and us about Karmatica. If part of these terms can’t be enforced, the rest still applies. If we don’t enforce a term right away, we haven’t given up the right to do so later. You can’t transfer your rights under these terms to anyone else. We may transfer ours to a company that takes over Karmatica, and your rights under these terms stay the same.
